This website was created, owned, and operated by the Fundação Casa da Música, with head office at Avenida da Boavista, 604-610, 4149-071 Porto, tax identification number 507636295, (hereinafter referred to as the “Foundation”), and its use is governed by these Terms of Use.

Acceptance of Terms of Use

The user of the website (“User”) acknowledges that by using this website, they accept these Terms of Use.

Changes to Terms of Use

The Foundation reserves the right to change, add, update, or delete, in whole or in part, these Terms of Use at any time, without prior notice and with immediate effect.

The User should periodically review these Terms of Use to confirm whether any updates or changes have been made. If you do not agree with any of the rules of use, you should not use the website.

Access to the Website

Access to the website is not subject to registration. The Foundation has the exclusive right to suspend, in whole or in part, access to the website at any time, especially (but not exclusively) during management, maintenance, repair, alteration, or modernization operations. The Foundation may also choose to permanently or temporarily close the website or any of its services, in whole or in part, at any time, without prior notice.

Use of the Website

The use of the website is subject to compliance with the following rules:

> Not to use the website to send or make available any illegal, false, misleading, threatening, malicious, abusive, defamatory, slanderous, invasive of privacy, racially, ethically, or morally reprehensible, harmful, or offensive content or content that may negatively affect the image of the Foundation;

> Not to use the website to send or make available information or content that belongs to third parties and that you do not have the right to use, such as content protected by third-party copyright or content containing third-party personal data;

> Not to use the website to provide or transmit any material that contains or may contain viruses, worms, defects, trojan horses, or other computer items or codes, files, or programs that may interrupt, destroy, or limit the functionality of any computer equipment or system (hardware or software) or communications equipment;

> Not to use or exploit, for commercial purposes or in any way that is paid, the website, including its content, materials, features, or resources (any content provided may only be accessed for personal use).

> Not to remove any copyright notice, trademark, or ownership notices;

> Not to impersonate anyone or any entity, including but not limited to a representative of the Foundation, not to host or receive someone as if you were a host, or falsely testify to relationships or connections with someone;

> Not to provide or transmit any unsolicited or unauthorized content such as SPAM;

> Not to collect, store, provide, transmit, exploit, or reproduce information about other users (including usernames and/or email addresses) for unauthorized purposes.

In general, the User should use the website responsibly, prudently, and carefully, without disturbing or degrading its continuity, integrity, and quality of resources and functionalities. The User acknowledges that their use of the website is at their own risk, and they are solely responsible for any damage caused to their system and/or computer equipment or other damages or losses, including loss or damage to data, resulting from the use of materials, content, or information obtained in any way through the website.

Additionally, the User acknowledges that if they provide their data (identification, contact, and bank data in the context of the completion of payment operations associated with the Casa da Música Ticket Office), the Foundation will make every effort to ensure the security of the information, but will not be responsible for the handling of such information by third parties (including entities providing payment services and financial transactions), nor is it possible to completely eliminate the risks inherent in data navigation on an open network.

Casa da Música Account

The User can access the website as a visitor. In this capacity, they can view generic information, such as information about the activities of the Foundation, consult the agenda, products available for purchase, among many others.

The User may choose to create a personal account (“Casa da Música Account”) to access certain features and elements of the website. In these cases, it will be necessary to provide a set of personal data which will be processed in accordance with the Privacy and Cookies Policy.

The User must keep the access data to their Casa da Música Account confidential, including not disclosing it to third parties or browsing under conditions that enable its decoding and copying by third parties. If the User forgets the access data to their Casa da Música Account, they must directly request the creation of a new password on the website.

The Casa da Música Account may be cancelled by the Foundation if it violates the applicable rules for the use of the website (including the Terms of Use and the Privacy and Cookies Policy).

The Foundation will send an email informing you that your account has been cancelled, using the contact email address provided by you when setting up the Casa da Música Account. The Foundation is not directly or indirectly responsible for any damages resulting from the cancellation of your Casa da Música Account.

The User may also, at any time, request the cancellation of their Casa da Música Account by emailing [email protected].

Ticket Office

The Foundation provides for the online purchase of tickets for events, concerts, workshops, tours, and/or other initiatives and activities of the Foundation.

The purchase of tickets online is not subject to prior registration of the User on the website, although it is necessary for the User to have a valid and active email address to complete the purchase transaction.

It is the User’s responsibility to make responsible and appropriate use of the Foundation’s online ticket office, including providing only payment data that pertains to themselves, or with the express consent of the respective holder, and ensuring that their banking and payment data are correct.

The User must follow the following steps to complete the purchase and collection of tickets through the online ticket office:

> Selection of relevant data for the purchase (identification of the activity in question, respective date/time, number of tickets);

> Identification of the requested identification and contact data, as well as data necessary for issuing an invoice – information marked with an asterisk (*) is mandatory and essential for completing the transaction;

> After steps (i) and (ii), the User will be redirected to a page at REDUNICRE, the entity responsible for processing the payment transaction and the procedures and data requested by REDUNICRE must be followed and provided;

> The purchase is considered completed and validated only after the User receives an email sent by [email protected]. This email will include the relevant information associated with the purchase, namely: purchase reference, invoice, and the ticket(s) in PDF format (sent as an attachment to the email).

If tickets have been purchased at a discount, presentation of supporting documents/entitlements for the discount in question is mandatory upon entry to the event

When using the online ticket office, security measures are employed for the transmission of potentially sensitive information, such as credit card identification data, which are protected through the use of secure certificates.

The secure certificate uses the public key/private key system, where the public key is used by the client to encrypt the information, and the private key, known only to the server, is used to “decrypt” the information. Installation of the certificate automatically activates the use of SSL (Secure Socket Layer), creating a secure communication channel between the server and the client’s browser.

Once activated by the certificate, SSL provides the following secure communication components:

> Authentication – The User can verify that the website being accessed does not belong to a third-party entity.

> Privacy – The information exchanged between the User’s browser and the server is encrypted using a key (with a unique key issued per session). The server sends the session key to the User, encrypted with the public key. These levels of protection ensure that the information cannot be viewed if intercepted by unauthorized third parties.

> Integrity – Given the content of the message, a security code is generated. The device receiving the message also receives the respective code, which is used to validate whether the content of the message has been altered. If even one character of the message has been altered, the original message generates a different security code.

Intellectual Property Rights

The User acknowledges that the website, its structure and layout, the selection, organization, and presentation of its content, including its features and the software used therein, as well as the trademarks, logos, and symbols displayed on the website, are owned by the Foundation or have been duly licensed to it.

The User further acknowledges that the contents of this website (texts, images, graphics, trademarks, sound and animation, and all other information and elements contained on the website) are protected by intellectual property rights and their use is limited to the terms permitted by law, along with identification of their source.

It is the Foundation’s responsibility to manage the design, layout, and arrangement of all information, content, and materials on the website, so the Foundation may, at any time, update, modify, or delete any content, services, options, or functionalities, as well as modify their presentation and configuration and change their respective URLs.

The User is not authorized to transmit, communicate to the public, publish, make available to the public, modify, transform, copy, sell, use, or distribute, in any form, the texts, images, or other information contained on this website or part of the website without prior written authorization from the Foundation.

The User may access and use the content and materials made available through this website for non-commercial purposes, with clear identification of their source (and link to the same). Any changes to the material must be clearly identified, and it cannot be stated or otherwise inferred that the use of the materials was authorized and/or supported at its origin. Distribution of derivative materials is prohibited. The User may not impose restrictions on the use of the materials by third parties accessing them beyond those resulting from these terms for the User.

The user should verify if there are third-party rights and obtain all other necessary permissions to carry out their activities without infringing property rights, violating a duty, or violating an agreement with third parties.

The user will defend, indemnify, and exempt the Fundação Casa da Música from all claims, actions, expenses (including attorney’s fees), damages, losses, and liabilities resulting from or related to any violation of these terms and conditions.

The use of this website does not necessarily imply the provision of personal data. However, if you wish to request contact and clarification, submit a complaint, comments, or suggestions, create a Casa da Música account, or provide consent for data processing for marketing purposes (including subscription to newsletters from the Foundation), you must provide us with some personal data. This data will be processed in accordance with the Privacy and Cookies Policy available on this website.

The information provided on the Foundation’s website is primarily intended to clarify and inform Users about aspects related to the Foundation’s activities, as well as the products and services made available to the public by it.

The website was developed with the interests of our different types of Users and the target audience of the Foundation’s own initiatives in mind.
